Insanity defense is one of the most illogical aspects of law. When a person kills someone they almost immediately tries to cover up the crime. Whether it be burying the body in the woods, dumping in a lake, making it look like a suicide or accident, and of course cleaning up the crime scene. These very acts to cover up the murder prove the person is not insane. They are completely rational thoughts and the killer has a clear understanding that what he did will have negative repercussions and he must hide his actions. All these acts prove he is sane. Now if a guy kills his wife and tries to bury her on the highway during rush hour or props up her body and takes her to a Knicks game I think we can listen to his insanity defense. But everytime a person does very pragmatic things to conceal a murder they just committed the insanity defense should not even be considered by a jury.
