Just asking a pretty simple question that I don't know the answer to....I thought somebody here with more experience and knowledge might know.
Basically, I'm thinking about filing for bankruptcy. Now, just wanted to know if I happen to win money gambling and let's say get lucky and win 5g, 10g, 20g.....whatever the number may be.
This is all hypothetical, since I dont bet big, and I usually lose anyway......Is there a law that says if I file for Bankruptcy, I'm not allowed to gamble? I don't think so.
And if I do get lucky and win, will they see the money in my checking account?

Debt service payments do zero good to the economy, so once you go bk and free up that money, you can use it for something productive. I filed chap 7 over five years ago. Just make sure you do the right things afterwords, you are being given a fresh start. best decision i ever made
as far as the money, just get it over with now, and then wait out the 3 or 6 months that you have to wait to make it a non issue. go see a bk attorney, they are hands down the best lawyers in all of the hell on earth that is lawyer land, and their services are very fairly priced. You should be able to go and get a free consultation, and for 1000$ or less be able to clean your slate. The only creditor that ever goes to bk court looking to recoup is(at least used to be) Sears, so if you don't have a Sears card, everything is yours to keep, except for the debt.
There are people that play this game the wrong way, Debt Managers, who know how to stay within the law, cheat, and work the system. don't do that
start a rainy day savings now with cash under your mattress. that will be your start up fund for new life 2.0. Don't accept any credit cards right away. bank at a credit union. get a CC 9-12 months after bk and use it sparingly and wisely, this will help you create a new credit history. I financed a car about 3 yrs after bk, and a house about 5. YOu get leper interest rates (at first) but if you go about it right, you can get to A tier credit (hell maybe even A+) by 2014

I agree JoeKool should cash out and pay off as much debt as possible. Not only that, he should explore all angles BEFORE filing BUT if the ship's bow is already in the air the BK is a lifeline that can save you sanity and you can start anew. DO NOT USE A DEBT RELIEF SERVICE IF YOU THINK YOU WILL STILL NEED A BK. YOU WONT BE ABLE TO BK AFTER MAKING AN AGREEMENT WITH THEM.
Take this advice, don't JUST file BK, re-examine your entire situation and make a plan to STAY out of not only financial debt but out of situations that can cause that debt. Change in lifestyle is often needed to do this. House to APT, Beer to water, NO Smoking, No Gambling, make your own meals cheap, cut back on wasted driving trips, basically live within your means and SAVE money in the bank. If you can't save after a BK, you are not trying hard enough or wasting money.
I was in a very bad pickle because the housing MKT crashed BEFORE I could sell my house which needed more $$$$$ into it than I could afford. I lost house, job and almost sanity before I BK'd. Times are still tough but easier than before and less complicated. THE HOUSE??? Sold for almost half of what I owed. I had refinanced and used all that to pay bills and fix the house which was a damn money pit that my wife wanted, not me. Had we bought the house I wanted we would still be living there. The house was a nightmare. Never Again. My pick next time.

American society creates people who want all the time, those who live with what they need do much better than those who chase every want created by our society. I already told my wife to be prepared, no more mister nice-guy from me, we are cutting back on everything and I'm gonna use all my frugal sence to teach her to do the same. Party's Over. I just wish my health was better so I had more energy but I'll make it happen. Slowly but surely things will turn around. Yes, I gamble still, but very small and gave up many things to still have a little fun with it within my means. Most people fart away more on fast food than I wager, I no longer drink, quit smoking, cook cheaper meals for MYSELF, don't waste gasoline making stupid trips(One trip or none, everything done from farthest to nearest then home), etc, etc.
Even though I filed BK and had lost my job, I never took unemployment because my employer forced me out of work by slowing doing things that hampered me. Now there is a new manager there(my friend) and he hired me back. The old manager, he a lowly worker now. Carma is a bitch.
