Oregon's son sues DHS marshal service and Federal border customs.

The Oregon Department of Justice is suing several federal agencies for civil rights abuses, and state prosecutors will potentially pursue criminal charges against a federal officer who seriously injured a protester.

The federal lawsuit names the U.S. Department of Homeland Security, the U.S. Marshals Service, the United States Customs and Border Protection and the Federal Protective Service, agencies that have had a role in stepped-up force used against protesters since early July. The state filed the lawsuit late Friday night.

It lists defendants specifically as John Does 1-10 because the "identity of the officers is not known, nor is their agency affiliation," the lawsuit states.

According to Oregon DOJ spokeswoman Kristina Edmunson, the suit accuses the agencies of engaging "in unlawful law enforcement in violation of the civil rights of Oregon citizens by seizing and detaining them without probable cause

Joining lawsuits filed by aclu and us attorneys request for a formal investigation into the constitutionality of the conduct of DHS.

This should be decided before Trump unleashes this force nationwide.

Portland Police Chief Chuck Lovell said the city department has contact with the federal personnel, but local officers still can't control the behaviour of the militarised troops.

The heavy federal presence has drawn criticisms from Democratic lawmakers, local leaders and civil rights groups. House speaker Nancy Pelosi tweeted that "Trump & his stormtroopers must be stopped."

Sen. Elizabeth Warren, D-Massachusetts, compared the unidentified federal officers to a "secret police force." Sen. Chris Murphy, D-Connecticut, called the incident involving Pettibone "chilling," and Sen. Jeff Merkley, D-Oregon, described it as "authoritarian."

Merkley and other lawmakers from Oregon are asking the inspectors general of the Justice Department and the Department of Homeland Security to investigate, decrying the “unrequested presence and violent actions” of federal officers in Portland.

“The jarring reports of federal law enforcement officers grabbing peaceful protesters off the street should alarm every single American. This is not the way a government operates in a functioning democracy,” Rep. Earl Blumenauer, D-Oregon, said in a statement.

I doubt,if they will win this law suit..CBP agents were sent to Portland to protect federal property. Federal agencies active in Portland were protecting the Hatfield Federal Courthouse.

Arresting "peaceful protesters" suspected of assaults against federal agents or destruction of federal property. HS Secretary Chad Wolf described nearly 100 incidents allegedly perpetrated by these "peaceful protesters" mostly vandalism of the courthouse and other federal buildings. 

From what I understand the president does not need a request from a state to use federal armed forces for domestic law enforcement under the Insurrection Act....

I love it when the Democrats, seemingly backing Antifa, looting and militant BLM protesters scream about the Federal government protecting federal agencies. Stormtroopers ? Now that is funny. What I think truly needs to happen is Trump sends in more so-called “ stormtroopers “ and they mistakenly open fire on these Sandinista inspired groups of insurrectionists. 

Yes they are in authority to protect federal property. But they can not assist local police without legislation from the state requesting it one posse law. They must wear the official uniform from the agency they represent. Uniform laws.

It's pretty clear on how the military can be used.

The Constitution permits Congress to authorize the use of the militia “to execute the Laws of the Union

Congress is not executive branch.

Posse Comitatus Act is violated when (1) civilian law enforcement officials make “direct active use” of military investigators; or (2) the use of the military “pervades the activities” of the civilian officials; or (3) the military is used so as to subject “citizens to the exercise of military power which was regulatory, prescriptive, or compulsory in nature.” The act is not violated when the Armed Forces conduct activities for a military purpose

It's not really a grey area this is illegal conduct.

And law enforcement personal should not be abuse. By ordered to commit such an aggevious unlawful act.

Stu.... keyboard tough guys?  You know nothing about me or anyone else.  I can speak for myself.  I have worked in some of the worst shitholes in probably the toughest cities.   I have taken and giving best downs protests ting the innocent.   I have no regrets nor apologies.   Todays youth been raised to believe they are entitled.   They are arrogant and pompous and instigate problems.  When they cant finish what they started.   Blame everyone else but themselves.  They have no discipline.    I deal with them everyday.
