Has anyone read the article from riverfronttimes.com?  It say the US has control of Gary Kaplan&#x27;s money and is going to give it out if you submit a petition explaining your right to the money.  There is also an article on the covers front page.  Is anyone in here a victim of the operation.  I am and they owe me $2,080.  I am going to look into this further tomorrow.

COURT CASE NUMBER: S5-4:06CR337 CEJ; NOTICE OF FORFEITURE

Notice is hereby given that on August 14, 2009, in the case of U.S. v. Gary
Stephen Kaplan, Court Case Number S5-4:06CR337 CEJ, the United States
District Court for the Eastern District of Missouri entered an Order condemning
and forfeiting the following property to the United States of America:
Approximately $43,650,000.00 in U.S. Currency presently held by the
United States District Court, Eastern District of Missouri, in Bank of
America account number XXXXX5233 which was transferred on or about
July 31, 2009, from Leecroft Investments Group's Swiss bank account at
Banque Privee Edmond de Rothschild S.A., Account number XXXXX0347
(09-IRS-000847).
The United States hereby gives notice of its intent to dispose of the forfeited
property in such manner as the United States Attorney General may direct. Any
person, other than the defendant(s) in this case, claiming interest in the forfeited
property must file a Petition within 60 days of the first date of publication (August
18, 2009) of this Notice on this official government internet web site, pursuant to
Rule 32.2 of the Federal Rules of Criminal Procedure and 21 U.S.C. § 853(n)(1).
The petition must be filed with the Clerk of the Court, 111 South 10th St., Suite
3.300, St. Louis, MO 63102, and a copy served upon Assistant United States
Attorney Charles S. Birmingham, Thomas F. Eagleton Courthouse, 111 South
Tenth Street, 20th Floor, St. Louis, MO 63102. The petition shall be signed by the
petitioner under penalty of perjury and shall set forth the nature and extent of the
petitioner's right, title or interest in the forfeited property, the time and
circumstances of the petitioner's acquisition of the right, title and interest in the
forfeited property and any additional facts supporting the petitioner's claim and
the relief sought, pursuant to 21 U.S.C. § 853(n).
Following the Court's disposition of all petitions filed, or if no such petitions
are filed, following the expiration of the period specified above for the filing of
such petitions, the United States shall have clear title to the property and may

warrant good title to any subsequent purchaser or transferee.

I spoke with my attorney about this.  He said this is a way for the government to easily prosecute you.  I still want to do it.  I wish I could say you can have 40% and we&#x27;ll call it a day.  I don&#x27;t have a fortune over there but I would still take 60% of it any day.  I&#x27;m not sure.  I want to do some more investigating.  I may speak to an attorney who will look into it and see what the deal is.  I want someone who will contact the authorities down in Missouri and get back to me.  I&#x27;ll keep everyone informed.

They owe me $6113 but I have dealt with the Federal Justice system and just because they haven&#x27;t prosecuted but 1 guy from ND for gambling, doesn&#x27;t mean they won&#x27;t try now. What an easy way to indict a large group of people to try to make an example.&#xD;&#xA; &#xD;&#xA;Remember, when dealing with the DOJ and FBI the Constitution mean nothing. In there words "you are considered guilty unless you prove you&#x27;re inocent." And even then you are looking at facing harsher penalties for facing your accusers than just giving in.&#xD;&#xA; &#xD;&#xA;I wrote it off already and not opening a can or worms hear.

Bonjamesbond-&#xD;&#xA; &#xD;&#xA;I hear you and a part of me completely agrees with letting a sleeping dog lie.  However, I think we are wrong if we don&#x27;t think they already know exactly we are, our address, what we are owed, etc.&#xD;&#xA; &#xD;&#xA;They do afterall have the BOS somputers which were accurate if you ever got a payout successfully when they were up and running.

Does a filing with the Clerk of the Court in the state of Missouri supercede a claim made 2 years ago with Vantis PLC?

The last report Vantis PLC provided was on June 23rd, 2009, and it stated an expected return of 5 cents on every dollar owed to players.

The way I understand it. Vantis has nothing to do with the settlement that Kaplen made with the U.S. And U.S. customers will be getting paid threw the U.S. settlement. The way I think it is working out now is Atlantis is taking care of BOsports employes and non US coustmers that BOS owed money to.

Contacted Vantis and my contact spoke to one of the insolvency practitioners and they are very confident that there will be a distribution to creditors as soon as the court proceedings are finished. No cash amount was told to me though.......

A lesson to all of us...and I do have sympathy for people who have gotten burned. But "those who don't learn from history are doomed to repeat it". This could potentially happen again at any time through any book.

Till US online gambling is regulated and legalized you only have "hope" of getting your $ back but no legal ground to stand on.

Until then like -3 1/2 on the Giants, understand the risks and choose to live with them or without them.
