    Let's take a vote: Who believes this is justifiable use of force?

    Let me try to give you a simple example.

    Some dude with no prior convictions stopped for DUI and cuffed would have a much much less chance of getting his head planted on the pavement for slipping the cuffs to the front than a well known multiple arrestee with a history of violence and resistance plus a very recent history of being called on with those same cops.

    Um no.  La Junta is a town of about 7000 people.  Everyone in that small police force has no doubt had dealings with or was familiar with this guy considering his past and his recent shenanigans

    Every false move by a criminal or otherwise should not result in death, paralysis or extreme injury. What are they TRAINED for and HOW are they trained? If this is the immediate response to a man trying to slip cuffs in front of him, change the entire dept. of that city.

    You see that's the thing.  Every false move by criminals or otherwise doesn't result in death, paralysis, or injury.  You scour the internet for these unfortunate mistakes and present them as an epidemic sweeping the country.  Although it has been years since I've trained, as a martial arts black belt I could still seriously injure anyone even with my hands cuffed in front of me.  With them cuffed behind me it would be much more difficult.

    This doesn't even speak to the cops having empathy or vicarious emotions of another that many here find not only emasculating, but repulsive (and that says a lot about your character and how well you'll do in marriage and friendships). I won't even broach that point as many here are devoid of feeling such things for certain people and we all know who they are.

    I have a lot of empathy for animals and children.  I would also have a lot of empathy for some guy that was for example illegally placing a bet over the internet and got raided by a bunch of cops who took him outside and pile drove him onto the pavement.  Distantly behind those examples, I do feel sorry for this guy, but i won't lose sleep over it.  (Read more about this guy's antics leading up to and during the ride to the hospital in other articles.)

    You however have lots of empathy, but it always seems to be misplaced.  There are a lot more sympathetic figures out there than historically criminal MMA trained dudes or teenage thieves in possession of drug making ingredients attacking nosey neighborhood watchmen

    "Duran's father said his son was quite troubled and had been arrested numerous times in the lead up to the incident that left him paralyzed." 

    "Donovan Duran, 24, was arrested outside his father's home in December in La Junta after family reported him being drunk and disorderly."

    The MMA fighter, who is continually in trouble, not to mention drunk, tried to free himself from cuffs. To me, I honestly don't think the cop intended to hurt the trouble making degenerate.

    Was the cop somewhat aggressive? Yes. Was he out of control? No. Did he purposely throw the guys head into the sidewalk? I don't believe so. To me it appears the cop pulled the guy from the car in an effort to stop the trouble maker from manipulating the handcuffs. 

    Let me see ...
    Trains to fight for a living (check)
    Trouble maker with the law (check)
    Repeat offender (check)
    His acts are so aggressive that his own family calls the police on him (check)
    Do the above check marks warrant certain measures taken by the law (that would be another 'check')

    Do I feel bad for this loser (leave this box Unchecked) 

    One less criminal that neighborhood has to deal with

    The criminal was belligerent and was attempting to fight by getting his hands from the back to the front and he told the officer "don't touch me" which is resisting arrest. What do you think a cop is going to do when he sees a suspect putting his handcuffed hands to the front and screaming don't touch me? The officer is going to control the situation for his own safety and regain control of the suspect. The idiot criminal is the one to blame for his own misfortune. I agree with sportsfan. Not excessive at all. Period!

    Excessive but I don't feel bad for the guy. If someone has you in that position do what they say. Here: don't make a move that can't be pointed to as trying to escape. I'd have a tough time convicting the cop too and yes I realize I said it's excessive so I should convict the cop.

    As though you can prove this and even if you could, like it would serve the larger point (which is the point) that any confrontation with a cop is likely one of the first confrontations in cities full of millions of people.

    I want to be clear here. This is very important and this will be the last post (I can only stomach so much).

    The names and avatars are above. Even posters who give the smallest amount of deference to the police in these situations are the VERY reasons these situations exist.

    Bullying and militant cops THRIVE off posters like Centaur, and Money and Search and Hugh and all others here (the names are clearly here in print).

    It is the EXACT reason why, when they kill or maim unjustifiably and moreover, extrajudicially, they release criminal records. They use that tactic for public absolution.

    It is because these people (and these posters are the most salient representations of 'these people') regard minorities and those of any race with any kind of criminal record as 'lesser human beings' or more precisely, 'lesser beings' (the word human be damned).

    At it's core, it is because these people have so little self-worth, they need to have a hierarchical mindset and place themselves 'above' the lowly criminal or minority, who by defaults elevates their status (in their own mind). 

    This they will deny and have always denied but the insinuation is clear as day.

    This man is PARALYZED. That, outside of death or blindness, is WORSE than being a vegetable (and many a people have been turned to vegetables in situations like this) because they are actually cognizant of they pain and inability to function, like this man is.

    Look at how Centaur is searching for every possible tap dancing excuse for what happened here. Bill Bojangles would tip his hat to this poster for the literal pirouettes he's done here. It's one move shy of clicking his heels together for the cops. This is EXACTLY what defense lawyers for the state do in criminal court.

    Look at Hugh Jordan's words.

    I want to be clear: This man is now paralyzed. This man needs assistance getting dressed, defecating, urinating, showering for the rest of his life. Forget employment or being a meaningful productive members of society. Forget being attractive to the opposite sex. Forget simple interaction with friends or family. These are the very things that give us self-worth. These will now all be denied to him because a cop felt his life was threatened as man bound in handcuffs inside a car tried to slip cuffs in front of him and decided to turn his neck into a jigsaw puzzle with his hands restrained. His response? Jam his neck into the ground. One poster here actual reads the heart and mind of the cop and posts "I don't think he meant to do that" (paraphrasing) which is quite common on juries after all the spin-doctoring.

    The amazing thing here is these posters haven't even heard a spin-doctoring defense attorney. They are here with a stick sprinkling holy water on them on their own!

    Folks, the world you live in and the way the police use force is shaped by THE VERY opinions in this thread. And the more of these people that find their way onto juries or excuse this conduct, the more you will see paralyzing, killing, assaulting, and militarization in any and all confrontations. Do not even breath heavy or blink wrong folks because if these posters are on the jury they are ready to throw the book...at YOU not anyone else. And if you have as much as a speeding ticket, for them, that qualifies as breaking the law and you should be drawn and quartered.

    Scal I know this is not what you wanted or understand. But this man is not an innocent either.did the cops snap yes. But as you may reason they are humans and are not perfect. You make a lot of posts of bad cops. Never one of the cop that saved a life or upheld his oath to protect and serve. You act like every cop is a another thug but clearly not the case.

    Cops although human are held to a standard over a cleric or minister aka priest. They are mentioned to be the user of deadly force. This punk is not even close to the grand mother that was faxed 25 times in Maine.  She obviously got sympathy of the court and the officer is not a cop any longer. These cops lose their careers regardless of the outcome of the case for the chances of them making detective are slim to none at best.

    Cops as as a policy do not have tenure they serve at the leisure of the chief who in turn serve at the leisure of town manager or mayor and city council who in turn serve by the will of the voter.
    We have checks and balances to stop abuse and corruption if you can fathom the politics policeman face 


    Yes each officer has each other's back and admitting mistakes is a mistake for it casts doubt with in the mind of John q public however relation between cops is by far a different field.     This they will deny and have always denied but the insinuation is clear as day.

    This man is PARALYZED. That, outside of death or blindness, is WORSE than being a vegetable (and many a people have been turned to vegetables in situations like this) because they are actually cognizant of they pain and inability to function, like this man is.

    Look at how Centaur is searching for every possible tap dancing excuse for what happened here. Bill Bojangles would tip his hat to this poster for the literal pirouettes he's done here. It's one move shy of clicking his heels together for the cops. This is EXACTLY what defense lawyers for the state do in criminal court.

    Look at Hugh Jordan's words.

    I want to be clear: This man is now paralyzed. This man needs assistance getting dressed, defecating, urinating, showering for the rest of his life. Forget employment or being a meaningful productive members of society. Forget being attractive to the opposite sex. Forget simple interaction with friends or family. These are the very things that give us self-worth. These will now all be denied to him because a cop felt his life was threatened as man bound in handcuffs inside a car tried to slip cuffs in front of him and decided to turn his neck into a jigsaw puzzle with his hands restrained. His response? Jam his neck into the ground. One poster here actual reads the heart and mind of the cop and posts "I don't think he meant to do that" (paraphrasing) which is quite common on juries after all the spin-doctoring.

    The amazing thing here is these posters haven't even heard a spin-doctoring defense attorney. They are here with a stick sprinkling holy water on them on their own!

    Centaur? Well if you can get through the babble, he's flipped and flopped so many times for this cop in this thread, a just-gaffed bluefish on a party boat charter would be envious.
     
    Folks, the world you live in and the way the police use force is shaped by THE VERY opinions in this thread. And the more of these people that find their way onto juries or excuse this conduct, the more you will see paralyzing, killing, assaulting, and militarization in any and all confrontations. Do not even breath heavy or blink wrong folks because if these posters are on the jury they are ready to throw the book...at YOU not anyone else. And if you have as much as a speeding ticket, for them, that qualifies as breaking the law and you should be drawn and quartered.
     
    It is a sad state of affairs to think this country and its laws are literally shaped (correction: mangled) by people like the posters above.

    A man sits paralyzed for life because he tried to move cuffs in front of him and his head was piledriven into the ground for it. The posters here? "He's nothing, let's move on."
     
    That is the hard-as s, empathy-less male who feels he'll be emasculated if he even considers an alternative point of view away from support of the cops in this situation.

    All I can say is, consider yourself lucky if you don't yet have this mindset. If you do? You're still alive and there's still time to consider alternative mindsets. I'm outta here.

    What events led up to Duran becoming paralyzed?

    Did police order Duran to become intoxicated? NO
    Did police order Duran to stand in the middle of an intersection? NO
    Did police order Duran to say “Don’t touch me?” NO
    Did police order Duran to place his handcuffed hands from his back, under his butt, behind his knees? NO
     
    Everything points to Duran’s own actions as the sole factor of his paralysis.

    Don’t get intoxicated.
    Don’t stand intoxicated in the middle of an intersection.
    Don’t resist arrest and tell police not to touch you.
    Don’t bring your handcuffed hands that are behind your back to the front of your body.
    Comply with police.

    Follow these simple commonsense rules and you won’t be paralyzed. Have a nice day.
