tlm, if i understand your question, and i'm not sure i do, you have to understand how the law views a minor. i'll use an obvious example.
assume kobe bryant is pissed because he missed the game winning shot and is in his hotel room when the hot little maid comes in and he forcibly has sex with her against her will. not saying that happened (not saying it didn't), just using it as an example. we can all agree that's rape and that's a crime. it's a crime because the other person has to consent for any legal sexual contact to take place. under the law, minors (anyone under 18) are automatically in the same position as that woman when any adult attempts to have sexual contact with them. they are not emotionally and mentally in a position to legally consent to sexual contact with an adult so any such contact is considered non-consensual and a crime. that's how it works.
adults, on the other hand, can consent to any sexual contact and the law doesn't distinguish between hetero or homosexual contact between adults. and it shouldn't make a distinction.
as for whether pedophiles are born that way or chose to abuse children, based on my experience, i think pedohiles have some innate, mental flaw that predisposes them to like children. obviously, it's ultimately a choice, but i think they have things going on where some of them can't control the urge. however, even if they are born with the pedophile gene 100% and can't control it, that's irrelevant in my mind as to whether they should be put in prison for it because the greater interest is to protect children.
