This was a private conversation in his own home secretly being recorded and released to try to spite him. Unlike Riley Cooper's comments made in public. This was not a public comment and not a team issue. He is allowed to have his own private thoughts in his own home, good or bad.
Of course I don't not know what the law states in this situation but I believe the NBA has no basis to fine him or take any action.
The players are playing to win for themselves and can leave when their contracts are up. Fans don't have to go to the games or watch.

Straight from the NBA rules, as applicable to all players:
Article 35, subsection c, "authorizes the NBA commissioner to impose fines or suspend players or both for any act or conduct that is "prejudicial to or against the best interests of the Association or the game of basketball".
This should apply to owners as well,imo.
This is not a 1st amendment issue, as you naively surmise, this is an NBA issue and they have the right to impose sanctions.
