Otherwise, she could say that she thought you were "gifting" her this cash as a going away present or "whatever" present. I would think that if you had no legal document, it's her word against yours.

You can certainly sue her in small claims court, but if she needed to borrow 5k then the money is likely gone. She doesn’t own real estate that you could attach a judgment to so she is likely judgment proof.
