 Correct and it is a federal case, so as long the  fascist/CONVICTED FELON is not elected in November then this criminal case against him will proceed and decided by a jury based on the merits - even if a different prosecutor and/or different judge!

Other judges disagree with Cannon's unusual decisions.  Clearly, she is biased and incompetent.  Ignoring merits in dismissal of the case is indefensible according to former attorney general Litman.  Corrupt Cannon has deviated from all previous courts that found the attorney general is authorized to appoint a special prosecutor.  Senator Durbin of judicial committee says this unprecedented decision undermines the entire system that US relies on to protect the independence of investigations of executive branch and prosecutions of political figures.  Justice department quickly authorized an appeal.

Special counsel Jack Smith has formally filed an appeal against U.S. District Judge Aileen Cannon’s shock ruling on Monday that dismissed former President Donald Trump’s indictment in his classified documents case.

The appeal, filed in the Southern District of Florida on Wednesday, argues against Cannon’s conclusion that Smith’s appointment by U.S. Attorney General Merrick Garland to prosecute Trump is unconstitutional because it did not go through Congress.

Peter Carr, a spokesman for Smith’s office, said in a statement released immediately following Cannon’s ruling that her decision breaks from how special prosecutors have previously and legally been appointed.

“The dismissal of the case deviates from the uniform conclusion of all previous courts to have considered the issue that the Attorney General is statutorily authorized to appoint a Special Counsel,” Carr said.
