this crime is the hardest one to come up with a fair sentence. they range from probation in some, although few, places to many years in prison in others. i've had a few of these cases over the years (actually have a very similar one now) and i can tell you that if he did that where i am now, he would be getting closer to 10 years in prison rather than 10 years on probation.

It's a hard one If I was to judge it was definitely the negligence of the defendant I hope his high price lawyer wasn't a major factor seems like it sometimes though.

I think since he was intoxicated, jail time should of been given. If he were sober and this occured, maybe 10 years probation but I'd still stick some jail time if i were the judge in that scenario also.

if he was sober, it's probably just a traffic ticket with a fine and driver improvement school.

i think that defense should only be allowed if it was like hunger games style. The rich parents offer themselves as tributes to serve the jail time for letting their kid be such an as.s hat his whole life

The punishment surely doesn't set a good precedent for others that might want to think twice about driving intoxicated especially being underage and having no business even drinking much less driving while he was drinking.
Probation might have been possible if it was a one vehicle accident and the occupants died but when he killed others that are not even involved then he deserves to get time for it.

Now that I have heard more of the particulars of the case I do see jail as the most appropriate punishments...
And if he does not go to jail because of the Affluenza BS defense then mommy and daddy should do 10 years each as accessories to the fact. (or whatever legal phraseology is appropriate)
Bottom line is someone should go to prison...

Good news is that kid still must be sentenced for 2 other charges AND the judge can change sentence within 30 days of her original decision..
This foolish accident was so horrific I'll just tell you one detail. Couple people were helping a stranded motorist in front of a family's house on a very dark stretch of country road no less...When 16 year old with .24 blood alcohol level comes careening around corner and crashes into disabled car, one of the girls killed was struck so hard (he was traveling 67 in a 45 mph zone) she and some of dismembered body parts flew in the air so far, parts of her landed in the neighbors yard some short distance away ..
Furthermore, a photographer sent out to the scene was so distraught upon what destruction he was witnessing, was so traumatized he couldn't bear to snap a single photo. This was repeated by so many others that arrived upon the scene..Absolutely a horrific CRIME commited by an underage rich punk who already had an alcohol prior......and he gets 10 years probation WTF??

Lastly, this story has enraged so many folks in the Metroplex you wouldn't believe....but you can't fire the judge..she is an elected official..some say she is a pretty good judge too(which I seriously doubt) Local radio talk show guy was so hot after this verdict he was giving out her home phone #
And yes, this kid will screw up again. just look at him....BTW, the first person to file a civil lawsuit against him and his parents, one of the kids riding WITH him...filed a $20 milion dollar suit
