Filming wasn't the issue... the arresting officer never told her to stop filming... her friend even picks up her camera and films her arrest... and (initially) she wasn't on her own property... see my post #89.
No one has the right to ignore instructions from police... especially not something as simple as "move back".
Ignoring instructions as simple as "calm down" is an arrestable offense in some states.
Oh....so I was right, the Gestapo police state has moved in & infiltrated our country. Just because someone has a badge, he can tell me what to do? Dude, this isnt 1950's & I wont be told to shut up or please step back when im standing on my own property, you lose!

Many of you can take the cops side, but until you've been wrongly arrested ( as i) you will open your eyes to the injustice and sheer bullying the police exert onto the common man just because he can.

Imo, she didnt break any law but what if you were given a jay walking ticket by an officer, are you saying you wouldnt try to get out of it or argue the fact just a bit?

She was wrongfully arrested..........she broke no laws. There was 3 cops there & the ones that had their back to her didn't seem to care that she was there (you could see one turn around & glance at her).
Cops with no fear of wrong doing shouldn't mind being taped, in fact I would think they'd welcome it. If anything had gone wrong, say the suspect tried to resist or escape, they could "subdue" him (LOL) w/o fear of public retribution because it was all vid'd.
NOW........if they had told her "We don't feel it's safe for you to be out here because (insert reason), please go inside", then she would be smart to obey the request.
The cop is a moron........he had two (maybe more) other cops with him & he didn't feel safe? Is this guy scared of his own shadow? What does he do when there's no back-up around......shit his pants?

I had a situation recently where I was stopped for a traffic check and the cop was a complete asshole.
Got pulled over for "not wearing seatbelt" which I was wearing at the time. I was in a line of cars of about 5-6 and the cop was on the opposite side of hte street making a right hand turn. After the 5-6 cars passed the cop pulled a U turn and threw his lights on. Ended up pulling me over.
As I watched the cars that were passing me they were all older people in their 40s-60s. Cop came to the window and asked if I knew why I was being pulled over and I told him I had no idea. HE said it looked like you weren't wearing your seatbelt and I responded with well I clearly am wearing my seatbelt, you were mistaken. He then asks for license/registration. I was driving my mom's car at the time and she had just bought the car 2 weeks ago and since there was some issues with the check engine light going on and off they had been unable to run an emissions test.
I handed him the registration and he told me the registration wasn't the real one and was only a receipt. I told him well maybe you should contact the dealership because they are the one who gave this registration and they are licensed by the state of Connecticut to register cars and hand out registrations. He then told me to search for another registration and I told him there is not another registration. He then asked why there was no front license plate on the car. This is when I lost my patience and explained to him that the dealership did not have the screws for Saab (saabs have different screws for the license plates than american cars) and thus were not able to affix the front license plate. I then asked if he was going to pull over the 10 cars I had seen pass while being stopped who did not have front license plates or the hundreds I see daily and he told me to mind my own business and he had not noticed any other cars without a front license plate.
While this is going on he asks what he sees in my wallet. I said you see nothing and he told no I see another ID, let me see it. I told him no that according to the state attorney that anything in my car is private property and you need a warrant. He said I am glad you know your rights but it is illegal to have 2 IDs so let me see it. I reluctantly handed my my ID and he said I am keeping this, it is illegal to have 2 IDs and I think you only have 2 because you are going to sell it to an underage kid. I said that is bullshit and I paid for that license and it is my personal property. I then said look at the date of my duplicate (the date was 12/31 about 6 months earlier is when i got my 2nd ID becuase I lost my first one around thanksgiving and never found it until a few months ago). I also told him the DMV told me if I ever found my lost ID to just keep it as a backup in case I ever lost the one I bought to replace it.
He eventually gave me a warning for not having proper registration, not front license plate and for not wearing a seatbelt. When he gave me these warnings I asked if he could tell me what Connecticut State Statue it said I was not allowed to have 2 IDs. He told me " I have no idea and dont have time to find out".... So basically he was enforcing a law that he was not even sure existed and the only confiscated my ID because he thought I was going to sell it to a minor.
I even went to the DMV after this incident and they said they would never ask anyone to return a 2nd ID if they found it becuase they purchased both. I went and looked at the Connecticut Statutes and was unable to find a law that mentioned 2 IDs. Eventually the chief of police called me said he had to call the DMV commissioners office to find out about the law because he did not/was not even sure it existed.
The cop might have been right but the way he busted my balls about everything was ridiculous. Then the fact he profiled me and accused me of going to sell my ID infuriated me. I still dont think my ID should have been taken.

There are also many people in my town who think this cop is a prick also. Old, young, male/female... every type of person who has interacted with this cop, that I talked to, has negative things to say.

Police can tell you to do whatever they feel is necessary... whether you comply or not is up to you BUT failure to comply with police instructions is an arrestable offense.
