Let's narrow the philosophers work to a concept.

Universability.  

An action is socially acceptable if it can be universalized (i.e., everyone could do it)

At what parameter do we infer that the majority of the House the party has on the other parties selection to committees. 

This is defining point of the argument.  

When exclusion without trial merely a majority can then dictate the house committee selection. 

When does this not become effectively silencing the minority party.

This is a false statement there are 435 members of the house of representatives most serve on committee or sub comittees. Of course how many is now obscured but 400 plus members have assignments at already weighted 2 minority to 3 majority.
