Judge Susan Bolton presiding over the criminal trial had the option of allowing a jury trial for a sentence cap of less than six months in jail and refused to do so................ isn't the purpose of the Sixth Amendment’s jury-trial process to determining whether a crime was committed ?
this is correct. you have no right to a jury trial for low level crimes like this. the judge can let you have one.
remember, all rights are limited. in the case of the 6th amendment, the right to a jury trial is limited to all cases except the least serious where the defendant is not likely to go to jail if he loses.
and yes, if it was me, i'd want a jury trial in most cases. sometimes, if the facts are kind of ugly but you have a good legal argument, a trial in front of the judge is better. but that's rare.
