Yeah, that was a strange copout. A special counsel's job should be gather all the evidence, determine if a crime was committed, and if yes what charges should be brought.
Not be whether the criminal is popular, unpopular, a nice old man, or is mentally fit today or not. He was obviously mentally fit when took military secrets and shared them with others. He copied classified secrets into a notebook and then claimed it was his personal property.
