Just throwing this out there. I had to let go an employee last week for embezzling approximately $5000 from my business. This employee was with me for over 10 years, and made me a pile of dough. Was excellent at sales and customer service. She really seemed contrite, really apologized and seemed sincere. She stated she was responsible for what she did, and accept the consequences. We got along very well, just a great employee. I am torn. Do I charge this person with embezzlement? I'd be very surprised if she ever did anything like this again, but who knows? She lost a very good job with good pay. Her sales were UP every year for the 10 years, no easy feat. I am leaning on NOT charging, I just don't see what good it would be to destroy her and her family. Not sure $5000 is worth all of that for what she made for me. I completely understand she stole from me, and I am disappointed and very angry about that.
Get this...she said it was because of her gambling addiction. No lie Please, no sexual innuendo comments. It was nothing like that.

Thanks Steve. Kind of what I was thinking too. It is just too bad. A real natural at the job. $5000 is really chump change compared to what she produced. I know I should be very upset, and I am, some, but what a waste. Even if it were triple that, I still came out way, way ahead. Don't steal, you WILL get caught!

Tough situation for sure. I agree should not prosecute. Maybe if it has been 50 or 100.000.
Maybe she thought she could "loan" the money from you and then put the accounts right when she won. They always think they win right.
Maybe if you want to be very generous you could offer her, her job back under conditions.. say she went through treatment for gambling... paid the money back.. ect.
But that is wholy up to you.. i am sure she is in a lot of pain right now.

That's a great idea, Mikeal. Just don't know if I could ever trust her again. I allowed this person to basically run things with little to no interference. She had it made. I am not hard to work for, but I do expect loyalty and honesty. For certain, I will miss her. She made some great contacts, was heavily involved in the community and everyone thought highly of her. If you have a good realtionship with her then I would probably let her sweat it out for a week or two, then I might offer her job back to her if she paid it back. I might also have her write an appology letter admitting to what she did and let her know that if it ever happened again you will definetly have her charged

I will consider that ricefan. Right now I am still a little shocked by this. But great idea. Glad I brought it up here. Not going to be easy to replace her, and hey, she did a bang up job!!! From what I can gather, this has been going on for 7/8 months. I am just sick over this.

Wall is right. You can't have someone back that stole from you just like you don't mix business with pleasure. It will create doubts and some awkward moments as it'll always be on the back of each of your minds.

Well it is difficult because if she is addicted to gambling and let it come to a level where she jeopardize her life and family , that means she is sick.
Yes she stole, but like alcoholism, it is the same with gambling. I would say that if you where to ever take her back, it can not happen without she receive treatment for gambling and entirely stop gambling.

This is no doubt a life changing event for you BOTH. First of all, your dream office has been turned upside down and it must be quite a shocker. As we know, nobody is indispensable, so you can and will eventually sail through these choppy waters and onward to a better place.
On the other hand, she is in a very tough spot. At age 52, she's got everything to lose. Her business career could be over, her marriage could be over, she might even be thinking her life is over.
I think if you take you back, it's a grand slam. You help her get back up on her feet and she will be twice the asset you thought you had. Everybody deserves a second chance. Do not hire her back ever. Once somebody steals from you, never let it happen again. Best way is to not put yourself in that position again.

If your other employees know about what happened, it might not be a good decision to bring her back. If it just between you and her, then I would probably offer her the job back with the understanding that she must pay the entire amount back. She has been loyal to you for 10 years- maybe you could show her some loyalty on your end as well? How did you discover the theft and are you sure that it hasn't been happening more than just this one time?
