It's not about her anymore. I doubt she'll steal again. The problem is the message you're sending your other employees. From a fellow employer, you can't hire her back.
In fact, you should have her sign a "non-compete" agreement with you in exchange for no charges.

A lot of good comments in this string! 5K is nothing, but the principal of the embezzlement makes it tough, very tough. Why not let it sit for a week or two, then make your decision? By that point, she may tell you she has another job, and the decion will be made for you.
If you do let her back, she MUST pay the 5K back! Also, as Sassycat comments, if others know about it, then you MUST let her go, or you will have a haven of thieves working for you.
85% of embezzlement is committed by employees, and naturally 55% of those are done by Management. Good luck, maybe you can check into her background? I am curious to hear the outcome of this.

Other people are not going to steal just because she did and didn't get fired.
If she makes you money and you want her around, save her. Don't worry about what the onlookers think. If worried about that, fire somebody else just for the hell of it.

Not thrilled about the drawn out aspect of the embezzlement though. If was an impulse thing, be easy to get over but if it was a drawn out thing, might not be able to get over that.

People are desperate out there. "john" knows that "sally" was able to steal 5k and keep her job/not get prosecuted. "john" falls behind on his mortgage and 10k will save his home...

Completely different situation.
Would certainly go way, way, way out of the way to keep/save a good employee though.

Nah......... people either steal or they don't. It's internal, has nothing to do with what other people are doing.
You saying You would steal if JerryRice80 did and got away with it?

I'm just one "opinion"........
Can still chop off a finger if you want but good employees are hard to find and training is a pain in the ass.
And it's only money.... and only 5k.... maybe the smallest embezzlement in history.
