    @Midnight1

is there any evidence he was going to harm someone after he fled ( he had a gun or a knife for instance ..) ?

in Idaho Falls, another guy was killed in his backyard after police officer mistook him for suspect on the run a traffic stop, which escalated to a brief manhunt

Just after 12 a.m. Monday, a Bonneville County sheriff’s deputy pulled over a car for a broken taillight, police said.

When the car stopped, a man later identified by police as Tanner J. N. Shoesmith, 22, jumped out and ran. The sheriff’s deputy called IFPD for backup, noting the suspect’s dark colored shirt.

a passenger in the car, who had stayed behind to cooperate with police, was receiving text messages from Shoesmith (the suspect) that included his GPS location, the department said. The person shared the location information with officers, who began to close in on the area.

The Idaho Falls Police Department said that the man who was being pursued was found hiding in a shed and was arrested. The Bonneville County Sheriff’s Office identified him as Tanner J. N. Shoesmith, 22, KIFI reported. He was booked at the Bonneville County Jail on outstanding warrants for failing to show up to court on charges of felony battery upon a police officer, resisting arrest, and providing false information to police, East Idaho News reported.

    @Raiders22

     Qualified immunity is the problem.

Police are not patrolling war zones

when does a Policer officer have to draw a gun ?

If the suspect is unarmed, why draw a gun , then shoot an unarmed person when there is no threat to his/her safety (for instance  suspect is fleeing like the Walter Scott shooting)

Yes.  The issue in question would be 42 U.S.C. § 1983.  This was established in the late 1800s to protect the folks that were fighting the KKK violence at the time.  There are calls now for Congress to amend § 1983. There have been many tweaks to this over the years to try to move this from 'subjective good faith' to a more 'objective terms'.  An attempt to make it plain to not just any 'reasonable officer' but to the least informed and least reasonable 'reasonable officer'. Most folks understand this I think.  But clarification might be needed in some areas of it.  I just am not sure in today's climate if there ever would be a medium.  Cops have to be able to do their job and not be overly hesitant to do it AND to have a standard to be held accountable to.  Not sure Qualified Immunity is THE problem as much as there is a pervasive disdain of cops.  It may be A problem -- but I see it as very much needed.

Police are not patrolling war zones when does a Policer officer have to draw a gun ?

Correct.  Generally, when there is a direct or obvious threat, such as a live-fire, hostage, or robbery situations.  The cop will usually not draw his weapon until there is a direct threat or non-compliance with a perceived threat. Of course, this is the area people disagree about and the obvious ones the media and 'activists' highlight -- but, still, very rare.

This is also not clearly defined and can be very subjective.  For instance, when doing a building search.  Some cops will have their gun out; others will wait until they actually encounter a human to draw it.

This is not a question that can be answered with a blanket statement.

If the suspect is unarmed, why draw a gun

This happens far, far less than people are led to believe.  Very few cops are just pulling their gun in these situations.  Unless they are in a situation where they are using a 'bootlegging' technique.  Most cops will only draw their guns a handful of times their whole careers.  I have known cops that never had to draw their gun their whole career.

, then shoot an unarmed person when there is no threat to his/her safety (for instance  suspect is fleeing like the Walter Scott shooting)

Again, this is so very rare.  Not to say that it is ever right.  But it is so rare that this is just about the only go-to in this argument.

    Stu,

Certainly this exists in many cases.....not all departments across the nation but it is plausible that many cops do hold that attitude.

(CNN) Federal prosecutors are moving forward with plans to charge Derek Chauvin
and three other former Minneapolis police officers with federal civil rights violations.

The Minneapolis Star-Tribune, citing a source, and KSTP-TV, citing sources with
knowledge of the investigation, say the Justice Department intends to ask a grand jury
to indict Chauvin in connection with the death of George Floyd, along with three other
former officers on scene -- Thomas Lane, J. Alexander Kueng and Tou Thao.

The Star-Tribune also reported prosecutors intend to charge Chauvin in connection
to the violent arrest of a 14-year-old boy in 2017.

    APRIL 14, CNN .......

Videos show the fatal police shooting of Michigan man
Police in Grand Rapids, Michigan, on Wednesday released several videos of an officer's encounter with Patrick Lyoya earlier this month, including two that show the fatal shot during a struggle after a traffic stop.
"The video clearly shows that this was an unnecessary, excessive, and fatal use of force against an unarmed Black man who was confused by the encounter and terrified for his life," civil rights attorney Benjamin Crump said.

The car was stopped because the license plate didn't match the car. The officer told the driver to stay in his car which he didn't & that was his 1st mistake. He was asked for his license, hesitated & ran away from the officer.

The officer caught the driver & they struggled for control of the officer's taser gun while they both fell to the ground & the officer reiterated a call for assistance over his radio.

IMO the driver never shouldn't have run but I don't think the officer should have shot him in the head after he had already subdued him.

His gun should never have left his holster.

Shot him in the head? That's an interesting wrinkle. Sounds like an execution.

Just saw the video. Sad for both parties as nobody should lose their life over a situation that became escalated unnecessary. Initial question would be, why did the driver get out of the car and not obey multiple reasonable requests and why run away, why resist and why fight for the taser? Why not just obey, take your traffic ticket for wrong plates, get your plates corrected and move on? Why were the plates wrong in the first place? If the plates were correct, this would very likely never happened. Was the car stolen or did someone just install the wrong plates?

Seems like these situations occur from minor infractions that are easily fixable but people escalate the situations instead of complying. Most children are taught at an early age to listen and obey an officer and you'll be fine, even if you are in the wrong. Seems like most people nowadays want to resist. I think I've seen those flags flying on homes. Is that the right message to send to people?

    @KellyM_1964

You left a few details out. Mainly all the details that escalated the situation.

What happens if he stays in his car, takes his fix it ticket and gets license plate situation fixed?  Not sure why people want to resist. Might be all those flags and messages people were sending over the last few years. Not quite the best recommendations, huh?

No need for deadly force over that.   Let alone shooting a man in the back of the head who he had pinned down and in position for handcuffing.

California woman fatally shot by police was victim of 'shocking' excessive force, lawyer says

Lawyers for the family of a California grandmother fatally shot by authorities accused police of excessive force Wednesday, saying that even though she backed her car into a law enforcement vehicle, she was unarmed and never threatened officers.

Tracy Gaeta, 54, died after a K-9 officer in Stockton fired more than 30 shots into her car Feb. 22, according to body camera video released April 7.

A lawyer for the family, Gary Gwilliam, said that the officer acted against policies adopted by many departments that bar or discourage police from firing at moving vehicles.

“No matter what was going on with her — even if she had committed a heinous crime — he didn’t have the right to shoot her,” he said in an interview. “She never threatened him.”

“The excessive force is shocking,” he added.

Looks like he had multiple attempts to handcuff but the suspect REFUSED TO COMPLY. How do you use one hand to grab handcuffs when the suspect has 2 hands to fight back?

Am not trying to justify what happened. But common senses is pretty clear that an officer can not handcuff someone larger, stronger and unwilling to comply while wrestling.

“The excessive force is shocking,” he added.

    and now another one !

her actions did not warrant a death sentence

    The videos,

    from a body-worn camera,

    an in-car camera,

    a cellphone

    and a home surveillance system,

show the final moments of Patrick Lyoya’s life.

Lyoya, 26, was killed on the morning of April 4.
That video shows the officer pin Lyoya down to the ground once more, with a knee to his back, grab his gun and shoot Lyoya in the back of the head while he is facing down.
