Fox News must face Smartmatic's lawsuit over false election-rigging claims

A New York state appeals court rejected
Fox News' bid to dismiss a multibillion-dollar defamation lawsuit
accusing the network of falsely accusing an electronic voting systems
company of helping rig the 2020 U.S. presidential election to
favor Joe Biden over Donald Trump.

In a 5-0 decision, the Appellate Division in Manhattan said
Smartmatic USA alleged in "detailed fashion" how Fox News
and some anchors and guests "effectively endorsed and
participated in (defamation) with reckless disregard for,
or serious doubts about" whether the company engaged
in election fraud.

CNN's Anderson Cooper and Elie Honig discussed Kohrs' interview Tuesday night and wondered if her media blitz was "responsible."

"First of all, why this person is talking on TV, I do not understand. Because, she’s clearly enjoying herself, but, I mean, is this responsible? She was the foreperson of this grand jury," Cooper said. 

Honig said it was a "horrible idea" and that the prosecutors were likely "wincing."

Honig, a former state and federal prosecutor, said that the interviews were a “horrible idea” and that prosecutors were probably wincing watching them, adding that it was “painful” to see Kohrs dropping hints.

“This is a very serious prospect here,” he said. “Indicting any person, you’re talking about potentially taking away that person’s liberty. We’re talking about potentially [indicting] a former president for the first time in this nation’s history. She does not seem to be taking that very seriously.”

Honig, a former assistant U.S. attorney, suggested that Kohrs’ comments could pave the way for Trump’s team to make a motion, should he be indicted, to dismiss the indictment based on grand jury impropriety.
